Q. What is a
Receiver?
A. A Receiver is an
individual appointed by the court who assumes
responsibility for all assets in the companies
that are being investigated. He is responsible
for employing professionals such as lawyers and
accountants to determine how the business was
operated and where all of the assets are
located. He also is charged with operating the
remaining elements of the business and
communicating with the investors. Receivers
create regular reports that are presented to the
court and made available to the investors. His
primary responsibility is to represent the
investor's best interests.
Q. Can I get my money
back now?
A. No. All invested
funds and assets that Mr. Kunen purchased with those
funds must remain frozen until the Court determines
that Mr. Kunen fraudulently obtained those funds
from investors, and authorizes the Receiver to make
distributions to investors.
Q. Will I get all of my
money back?
A. It is impossible to
determine at this time if investors will receive
100% of the funds they invested with Mr. Kunen.
While the Receiver has made significant progress in
marshalling and preserving the funds and assets of
the Estate of Mr. Kunen, at this stage in the
Receivership, it is impossible to determine
whether investors will receive 100% of the funds
they invested. The Receiver is working to protect
investor's assets to the extent possible, but there
is no way to predict at this early date how much
remains and how much if any of the funds will be
returned.
Q. How long will it take
for investors to receive their funds back?
A. It is impossible to
predict the total amount of time. The Receiver and
his professional staff are working hard to
accomplish their jobs but there is much to be done.
It is not uncommon for Receiverships to last a year
or more.

Q. Should I hire a
lawyer?
A. You certainly
have the right to hire or consult with your own
lawyer. As authorized by the Court, however, the
Receiver will be investigating all potential claims
or methods of recovery that he can bring for the
benefit of investors.
Q. Should I send
copies of my papers proving that I am a investor to
the Receiver?
A. Not at this
time. We will be instituting a formal claims
process in the future and will ask that you forward
copies of these documents at that time.
