The District Court has
not yet authorized the Receiver to make any
distribution of funds to investors. Therefore, the
Receiver has not made any distributions to
date. Only after the Court has formally determined
that Mr. Kunen fraudulently obtained the funds from
investors will it authorize the Receiver to make
distributions.
Once authorized,
distributions will be made to investors on a pro
rata basis, depending on how much money each
investor transfered to Mr. Kunen. The Receiver
expects to make a series of partial distributions to
investors over time, instead of one lump sum
distribution, as the Court authorizes each partial
distribution. While the Receiver has made
significant progress in marshalling and preserving
the funds and assets of the Estate of Mr. Kunen, at
this stage in the Receivership, it is impossible to
determine whether investors will receive 100% of the
funds they invested.
